California Dependency Law.

We have a dependency law case that we are defending. Our client was charged with domestic violence and now the CPS agents are attempting to take the child from the house and terminate the parents rights. We have a comprehensive discovery motion that we filed that outlines the rights of the parents in such a situation. It appears that the prosecution is using the CPS proceeding to gather evidence for the criminal case. Fortunately, we have been able to file the appropriate motions that we expect will preserve the record in the event that the criminal courts allow the testimony and evidence obtained in the dependency proceeding. We'll be posting a sample of this work in the gallery portion of this site.

You need to present evidence that the allegations are not substantiated. We've been going through literally months of trial, albeit one day a month. If the case is not resolved in your favor in the Superior Court, you have little chance of success in the court of appeals.
