AND DENYING REHEARING


NO CHANGE IN JUDGMENT



THE COURT:


It is ordered that the opinion filed herein on September 18, 2006, be modified as follows:


1. On page 1, counsel listing, third sentence, delete the words “and Cecil McNab.”


2. On page 2, line 1, change the word “Appellants” to “Appellant”, delete the words “Cecil McNab (McNab) and” and change the word “appeal” to “appeals” so that the sentence reads: “Appellant A/R Capital LLC (A/R Capital) appeals the trial court’s grant of Santa Monica Properties’ (SMP) motion for nunc pro tunc correction . . . .”


3. On page 6, first line after the caption “DISCUSSION”, delete the words “McNab and” and change the word “make” to “makes” so that the sentence reads: “A/R Capital makes numerous arguments on appeal, . . .”


4. On page 6, footnote 6, line 1, delete the words “and McNab” and change the word “have” to “has, so that the sentence reads “In connection with this appeal, A/R Capital has requested we take judicial notice. . . .”


Appellant’s petition for rehearing is denied.
