It is ordered that the opinion filed on December 27, 2007, is modified as follows:
On page 3, the second sentence of the second full paragraph is deleted and replaced with the following sentence:
Mays negotiated a more lucrative consulting agreement with Norcal in January 1995.
[There is no change in the judgment.]
