THE COURT:
The typewritten opinion filed herein on March 27, 2007, is modified in the following manner.
On page 13, delete the word reasonable on the fourth line following the indented paragraph, and insert the word unreasonable in its place so that sentence reads:
Given Forbess failure to lodge any objections after that hearing, it is not unreasonable to conclude he acquiesced in the procedure.
This modification does not change the judgment.
