THE COURT:


The opinion in the above entitled case filed March 1, 2006, is modified as follows:


On page 28, under DISPOSITION, change the first paragraph to read as follows:


The order denying Ralphs' motion for a judgment notwithstanding the verdict is reversed and the matter is remanded to the trial court with directions that it enter a judgment for the Finton Plaintiffs by reducing the award of punitive damages to six times their respective compensatory damages awards. The Finton Plaintiffs' appeal from the new trial order is dismissed as moot.


The petition for rehearing is denied.
