INTRODUCTION


In our prior nonpublished opinion, Hambarian v. City of Orange (Oct. 14, 2004, G033118), we affirmed the judgment following an order sustaining without leave to amend the City of Orange's (the City) demurrer to Alyce A. Hambarian's (Hambarian) complaint for rescission of a settlement agreement entered into between the City and Hambarian, other Hambarian family members and family-owned entities. The trial court thereafter awarded the City prevailing party attorney fees based on the settlement agreement's provision for such an award â€
