DIVISION TWO

In re ANTHONY G. et al., Persons Coming Under the Juvenile Court Law.

SAN BERNARDINO COUNTY DEPARTMENT OF CHILDREN'S SERVICES,

Plaintiff and Respondent,

v.

E.R.G.,

Defendant and Appellant.

E039679

(Super.Ct.Nos. J190713-15)

APPEAL from the Superior Court of San Bernardino County. Robert G. Fowler, Temporary Judge. (Pursuant to Cal. Const., art. VI, § 21.) Affirmed.

Linda M. Fabian, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

E.R.G. (Mother) appeals from an order of the dependency court terminating her parental rights as to her children, 9-year-old A.G., 8-year-old E.G., and 3-year-old Anthony G. We find no error and will affirm the judgment.

In September 2003, the children came to the attention of the San Bernardino County Department of Children's Services (DCS) after Mother had left then one-year-old Anthony and five-year-old E.G. in the home for several hours without supervision. During this time, the boys were exposed to high levels of natural gas. E.G. was found unconscious and was hospitalized. While hospitalized, medical staff discovered E.G. had brittle diabetes, which had not been adequately controlled. Mother was arrested for child endangerment, and the children, including A.G., were taken into protective custody. Each boy had a different father, and none of the fathers could be located.

This was not the first instance of neglect by Mother. Mother had a prior substantiated allegation for general neglect in May 2002. Mother had received voluntary services from May 2002 to August 2002.

Mother informed the social worker that she suffered from depression after Anthony's father had left her when she was seven months pregnant with Anthony. She stated that she had attempted suicide at that time. Her depression had become worse. She was open to receiving services to assist her.

On October 3, 2003, DCS filed amended section 300 petitions on behalf on the boys pursuant to Welfare and Institutions Code section 300, subdivisions (b) and (g).[1] Mother wanted the boys placed with her mother, but because Mother lived with the maternal grandmother and was in the process of being evicted, that placement was not an option. E.G. and Anthony were initially placed together, but E.G. was moved to a different foster home after he displayed extremely aggressive, violent behavior toward Anthony and the foster mother. E.G. was subsequently involuntarily hospitalized due to his behavior problems. He was described as â€
