Appellant
Carole Marasovic seeks review of a summary judgment entered in favor of
respondents in an action arising out of the death of appellant's mother at
Shields-Richmond, a nursing home.
Respondents are Alta Bates Medical
Center (Alta Bates), the hospital where appellant's mother was treated
shortly before her death, and Linda Bradford, a social worker at Alta Bates.
Appellant
contends that the judge who granted respondents' summary judgment motion was
biased against her; that the trial court erred in declining to consider the
expert declaration she submitted in opposition to the href="http://www.fearnotlaw.com/">summary judgment motion, and in refusing
to allow her to substitute the belatedly filed declaration of another expert;
that the court should have found a triable issue of material fact, either based
on the other evidence she submitted or on a negligence
per se theory; and that the court should not have sustained respondents'
demurrer to her causes of action for intentional
infliction of emotional distress and elder abuse. We reject all of these contentions, and affirm the judgment. style='mso-footnote-id:ftn1' href="#_ftn1" name="_ftnref1" title=""> class=MsoFootnoteReference>[1]
