A judgment of dissolution of marriage provided that the spousal support award was nonmodifiable until the husband reached the age of 62. A month before his 57th birthday, the husband requested that the court issue a Gavron warning[1] to the wife, admonishing her that she should endeavor to become self-supporting within the next five years. The court denied the request for the Gavron warning and the husband appeals.


The judgment of dissolution did not require that a Gavron warning be given at the five-year-remaining mark and the court did not abuse its discretion in refusing to issue the warning. The order is affirmed.

FACTS


Ronald and Jacqueline Moran were married on December 5, 1970 and separated on April 1, 1993.[2] Ronald filed a petition for dissolution of marriage on May 27, 1993. At the time, Jacqueline was a 43-year-old homemaker with a junior college education.


On June 4, 1993, Jacqueline filed an order to show cause for spousal support. She sought $7,000 in monthly spousal support, plus other sums. According to his September 3, 1993 income and expense declaration, Ronald was a 46-year-old salesman/consultant with Moran Bros., Inc., with a gross monthly income of $17,049.17 over the preceding 12 months. However, in his September 3, 1993 responsive declaration, Ronald stated that his only source of income was then $3,125 per week from ServMor, Inc. He also stated: â€
