THE COURT:
It is ordered that the opinion filed herein on July 3, 2007, be modified as follows:
1. On page 1, the opening paragraph, beginning APPEAL from a judgment is deleted and the following paragraph is inserted in its place:
APPEAL from a judgment of the Superior Court of Stanislaus County. David G. Vander Wall and Roger M. Beauchesne, Judges.
2. The following footnote is added at the bottom of page 1:
Judge Vander Wall considered and ruled on the motions. The orders granting the motions and the judgments were signed by Judge Beauchesne in Judge Vander Walls absence.
Except for the modifications set forth, the opinion previously filed remains unchanged.
This modification does not result in a change in judgment.
