Jimetta Moore sued Avaya, Inc., and Larry Holt, her former employer and one of her former supervisors, alleging discrimination, wrongful termination, and a variety of other causes of action.[1] Avaya prevailed by summary judgment, then moved unsuccessfully for an award of attorney's fees. Moore appeals from the judgment, and Avaya appeals from the order denying its motion for fees. We affirm the judgment and the order.


FACTS


A.


Avaya hired Moore in 1964 and for the next 35 years Moore advanced steadily -- from part-time telephone operator to supervisor, to marketing sales manager, to human resources director, and to an executive on loan to the Rebuild Los Angeles Program. Moore was laid off on June 30, 2000, and never rehired. She receives retirement benefits from Avaya.


In September 2000 and again in August 2001, Moore filed a series of administrative complaints with the Department of Fair Employment and Housing, alleging that Avaya and Holt had wrongfully â€
