IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SECOND APPELLATE DISTRICT

DIVISION FOUR

THE PEOPLE,

Plaintiff and Respondent,

v.

ARUTYAN ASATRYAN,

Defendant and Appellant.

B180774

(Los Angeles County

Super. Ct. No. LA043622)

APPEAL from a judgment of the Superior Court for Los Angeles County, John S. Fisher, Judge. Affirmed as Modified.

Trutanich & Michel, Carmen A. Trutanich, C.D. Michel, and Lynda J. Westlund for Defendant and Appellant.

Bill Lockyer, Attorney General, Robert R. Anderson, Chief Assistant Attorney General, Pamela C. Hamanaka, Assistant Attorney General, Margaret E. Maxwell and William H. Shin, Deputy Attorneys General, for Plaintiff and Respondent.

Defendant and appellant Arutyan Asatryan appeals from a judgment sentencing him to nine years in state prison after a jury found him guilty of assault with a firearm (Pen. Code, § 245, subd. (a), (d)). He contends on appeal that he received ineffective assistance of counsel and that the trial court abused its discretion by denying his motion for a new trial. We disagree.
