On December 1, 2004, defendant Juan Bermudez entered a grocery store, pocketed two beers and left without paying for them. Two store employees followed Bermudez outside and asked him for a receipt for the beers. Bermudez threw the beers to the ground and tried to run away. The employees apprehended Bermudez after a struggle and he was arrested by a nearby police officer.


Bermudez was charged with petty theft with a prior, a felony. (Pen. Code, § 666.)[1] The information alleged that Bermudez had two prior serious â€
