Melvin Patrick Carter was charged by amended information with attempted premeditated murder (two counts), conspiracy to commit murder, and being an accessory after the fact. (Pen. Code, §§ 187, subd. (a), 182, subd. (a)(1), 32.) Each count specially alleged multiple enhancements.


On the day of trial, the amended information was amended by interlineation to add a charge of assault with a firearm. (Pen. Code, § 245, su bd. (a)(2).) Carter pleaded no contest to that count, and he admitted having previously suffered one prior â€
