IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SECOND APPELLATE DISTRICT

DIVISION THREE

THE PEOPLE,

Plaintiff and Respondent,

v.

LAVELL DILLARD,

Defendant and Appellant.

B187146

(Los Angeles County

Super. Ct. No. BA107138)

APPEAL from an order of the Superior Court of Los Angeles County,

Kathleen Kennedy-Powell, Judge. Affirmed.

John F. Schuck, under appointment by the Court of Appeal, for Defendant and Appellant.

No appearance for Plaintiff and Respondent.

_________________________

Lavell Dillard appeals an order denying his request for resentencing pursuant to Blakely v. Washington (2004) 542 U.S. 296 [159 L.Ed.2d 403].

We appointed counsel to represent Dillard on this appeal. After examination of the record, counsel filed an ex parte motion in the superior court seeking correction of the abstract of judgment to conform to the trial court's oral pronouncement of judgment, then filed an opening brief which raised no issues and requested this court to conduct an independent review of the record. On March 21, 2006, the trial court issued minute orders granting appointed appellate counsel's request to correct the abstract of judgment.

By notice filed January 18, 2006, the clerk of this court advised Dillard to submit any contention, ground of appeal or argument he wished this court to consider within 30 days. No response has been received to date.

We have examined the entire record and are satisfied Dillard's counsel has complied fully with counsel's responsibilities. (People v. Wende (1979) 25 Cal.3d 436, 443; Smith v. Robbins (2000) 528 U.S. 259, 278-284 [145 L.Ed.2d 756].)

DISPOSITION
