Terry Haddix was convicted of attempted murder with sentence enhancements for personal weapon use, personal infliction of great bodily injury, a prior serious felony, and two prior prison terms. He contends the court misinstructed the jury; that one prior prison term enhancement is not supported by the evidence, and that the court erred in imposing a $10,000 restitution fine. We affirm.
BACKGROUND
Prosecution Case
The charged crime took place at Pelican Bay State Prison, where both defendant and the victim, John Hancock, were inmates.
Hancock is one of the founders of a Sacramento street gang known as the â€
