Counsel appointed for defendant Earl Leslie Heltsley has asked this court to examine the record in accordance with People v. Wende (1979) 25 Cal.3d 436. That examination reveals the following:
At the preliminary examination, Richmond Police Officer Harris testified that he was approached by a man named Rogers, Rogers's girlfriend, and her daughter. Harris has known Rogers for about a dozen years. Rogers and the daughter advised Harris that defendant (who was Rogers's half-brother) was at a donut shop (where the daughter worked and where defendant lived) â€
