Defendant Ryan Knowles-Browder pled guilty to receiving stolen property and possessing methamphetamine and agreed to a Cruz[1] waiver. In exchange for his plea and waiver, two related counts were dismissed. The trial court later denied his motion to withdraw his plea and sentenced him to state prison for three years.


On appeal, defendant contends the trial court abused its discretion when it denied his motion to withdraw his plea because the evidence clearly and convincingly showed that he did not understand what he was doing at the time he entered his plea. We disagree and shall affirm the judgment.


FACTUAL AND PROCEDURAL BACKGROUND


The court appointed Joseph Gasperetti's office to represent defendant, and Gasperetti assigned the case to Bill Briggs for defendant's arraignment on November 17, 2004. Thereafter, both attorneys handled defendant's case.


Gasperetti discussed the charges with defendant on November 22. Defendant told to Gasperetti that he was interested in making a deal with the district attorney's office in exchange for some information he had.
