ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING |
The petition for rehearing filed by appellant in the above entitled action is denied. On this court’s own motion and for good cause shown, the opinion filed on September 21, 2006, is hereby modified as follows:
The third line of page 9 which reads in part, “By renewing the issue, appellant abandoned his claim,” is modified to read “By not renewing the issue, appellant abandoned his claim.”
The remaining portions of the opinion are unaffected.
