On December 17, 2002, based upon his guilty plea to corporal injury on a cohabitant and dissuading a witness by force or threat (Pen. Code, §§ 273.5, subd. (a), 136.1, subd. (c)(1)),[1] defendant Clayton Robert Lee was granted probation conditioned upon service of 90 days in the county jail, performance of 200 hours of community service, payment of a $200 restitution fine (§ 1202.4, subd. (b)) and a $200 domestic violence program fee (§ 1203.097, subd. (a)(5)).


On June 30, 2003, at a probation review hearing, defendant disclosed to the court that he would test positive for marijuana as he had consumed it the previous Saturday. It was agreed that no violation of probation petition would be filed, and that defendant would write the court a letter of apology and attend a chemical dependency class.


On January 26, 2004, probation filed a petition alleging defendant had violated probation by testing positive for marijuana, had terminated his participation in the family violence education program without the probation officer's permission, and had failed to report a law enforcement â€
