Pursuant to a negotiated open plea, appellant Zohrab Serobyan pled no contest to attempted murder (Pen. Code, §§ 664/187, subd. (a)) and admitted that during the commission of the offense he personally inflicted great bodily injury within the meaning of Penal Code section 12022.7, subdivision (e). He was referred to the Department of Corrections for a 90-day diagnostic report pursuant to Penal Code section 1203.03. Thereafter, he was sentenced to the low term of five years for the base term and an additional three years for the great bodily injury enhancement. Appellant's motion to recall his sentence was denied. On May 3, 2005, his motion to set aside his guilty plea and his petition for writ of habeas corpus were denied.
