ORDER MODIFYING OPINION



[NO CHANGE IN JUDGMENT]



THE COURT:



It is ordered that the opinion filed herein on August 7, 2007, be modified as follows:



On page 2 of the opinion, after the last sentence of the first paragraph, which begins on page 1 with the words California has two statutes that prohibit the seller, footnote 1 is added to read as follows:



Effective July 1, 2007, the Department of Health Services was reorganized into the Department of Health Care Services and the Department of Public Health. In this opinion, we will simply refer to the former name, Department of Health Services.



The rest of the footnotes shall be renumbered accordingly. There is no change in the judgment.
