A decision as to committing Appellant to the Department of Mental Health for treatment as a mentally disordered offender. Appellant contends that the trial court violated his constitutional and statutory rights when it denied his request for self-representation and failed to conduct a hearing under People v. Marsden (1970) 2 Cal.3d 118 (Marsden), and accepted his counsel's waiver of a jury trial. Court affirms.

The court declared appellant a ward and placed him on probation, with the maximum time of confinement set at four years, four months and 25 days. This appeal followed. We reverse the judgment as to the reckless driving, burglary and receiving stolen property counts and affirm as to the possession count.

Appeal from a judgment entered on his plea of nolo contendere in the allegation of possession of a firearm by an ex-felon and willful discharge of a firearm in a grossly negligent manner. His counsel raises no issues and asks this court for an independent review of the record to determine whether there are any arguable issues.
