The court orders the opinion filed herein on June 20, 2007 modified as follows:



On page 10, in the first full paragraph, after the third sentence, insert the following sentence: As we have discussed, he also presented evidence from which a jury could infer Unocal knew or should have known his exposure to asbestos was hazardous.



This modification does not alter the judgment. Appellants petition for rehearing is denied.
