THE COURT:*


It is ordered that the opinion filed herein on March 3, 2006, is modified in the following particulars:


1. On page 2, delete the first two sentences of the third paragraph of the Factual and Procedure Summary, and replace them with the following:


The solution was to hire a truck and driver to come to the scene and assist in loading the Snorkelift onto the truck. Garcia telephoned Gilberto Molina, the owner and operator of a flatbed tow truck with a tilt-bed, and asked him to come to the residence with the truck.


2. On page 3, the third sentence of the first full paragraph is deleted and the following is inserted in its place:


Unfortunately, the brakes allegedly were not set.
