Defendant Andres Ramirez Ramirez was charged with false personation exposing another to liability (Pen. Code, § 529). It was also alleged that defendant had suffered a serious prior felony conviction within the meaning of Penal Code sections 667, subdivisions (b) through (i) and 1170.12, and had served a prior prison term within the meaning of Penal Code section 667.5, subdivision (b).
On June 9, 2005, defendant pleaded guilty as charged and admitted the prior conviction and prior prison term allegations.
On August 30, 2005, the trial court heard and denied defendant's motions to reduce the charge to a misdemeanor pursuant to Penal Code section 17, subdivision (b) and to dismiss the strike prior pursuant to People v. Superior Court (Romero) (1996) 13 Cal.4th 497. Defendant was sentenced to a term of 32 months in the state prison. The trial court struck the punishment for the prior prison term enhancement pursuant to Penal Code section 1385.
