This a consolidated appeal by L.M. (hereafter mother) and A.M. (hereafter father) from the trial court's disposition order on a Welfare and Institutions Code section 300[1] petition that Riverside County Department of Public Social Services (hereafter DPSS) filed on November 16, 2004, with respect to mother and father's two children, M.M. (then four years old and autistic), and J.M. (then seven years old). DPSS alleged in the petition that the children came within the provisions of section 300, subdivision (b) because their parents both use controlled substances, were recently arrested for possession of a controlled substance for sale, and engage in domestic violence in the presence of the children.
The drug allegations stemmed from a probation search of the family home[2] in which law enforcement officers recovered nine grams of methamphetamine along with paraphernalia that included scales and pipes. J.M. was at home with father, who appeared to be under the influence of a controlled substance, at the time of the search. M.M. and mother returned to the house while the search was in progress.
