Kenneth Draper appeals from the trial court's order revoking probation and ordering into execution a previously suspended state prison sentence. In an open plea to the court, Draper pleaded guilty to identity theft, forgery, and two counts each of second degree burglary, possession of a forged driver's license, and attempted grand theft.[1] The trial court sentenced him to five years in state prison, but suspended execution of sentence and granted Draper three years of formal probation.


Following a contested hearing, the trial court found Draper had violated his probation by his failure to report to his probation officer and to comply with drug testing, and by his conviction on related felony charges in Orange County. The trial court revoked Draper's probation and ordered execution of the previously suspended five-year state prison sentence.


We appointed counsel to represent him on appeal.
