IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA
SIXTH APPELLATE DISTRICT
THE PEOPLE, H029495
Plaintiff and Respondent, (Santa Clara County
Superior Court
v. No. CC590677)
RUSSELL LOPEZ,
Defendant and Appellant.
_____________________________________/
Defendant Russell Lopez was convicted of possession of methamphetamine (Health & Saf. Code, § 11377, subd. (a)) and being under the influence of a controlled substance (Health & Saf. Code, § 11550). He also admitted that he had suffered a prior conviction under the Three Strikes law (Pen. Code, §§ 667, subds. (b) - (i), 1170.12). He was sentenced to 32 months in state prison and filed a timely notice of appeal.
Appointed appellate counsel has filed an opening brief which states the case and the facts but raises no issues. Defendant was notified of his right to submit written argument on his own behalf but has failed to avail himself of the opportunity. Pursuant to People v. Wende (1979) 25 Cal.3d 436, we have reviewed the entire record and have concluded that there are no arguable issues on appeal.
The judgment is affirmed.
