IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA
SIXTH APPELLATE DISTRICT
THE PEOPLE, Plaintiff and Respondent, v. MARTIN COSME BARRIOS, Defendant and Appellant. | H028835 (Santa Clara County Super. Ct. No. CC457487) |
Defendant Martin Cosme Barrios appeals from a judgment entered after denial of his motion to suppress evidence (Pen. Code, § 1538.5) and the subsequent entry of his no contest plea to possession of methamphetamine for sale (Health & Saf. Code, § 11378), driving under the influence of drugs and alcohol (Veh. Code, § 23152, subd. (a)), being under the influence of methamphetamine and phencyclidine (Health & Saf. Code, § 11550, subd. (a)), possession of methamphetamine (Health & Saf. Code, § 11377, subd. (a)), and driving with a suspended license (Veh. Code, § 14601.1, subd. (a)). Defendant also admitted that he had previously been convicted of a prior drug offense qualifying for enhanced punishment under Health and Safety Code section 11370.2, subdivision (c). Pursuant to the plea bargain, the trial court imposed three years and eight months in state prison and concurrent county jail sentences for the remaining counts. Punishment on the enhancement was stricken. This appeal ensued.
We appointed counsel to represent defendant in this court. Appointed counsel filed an opening brief which states the case and the facts but raises no specific issues. We notified defendant of his right to submit written argument in his own behalf within 30 days. That period has elapsed and we have received no written argument from defendant.
Pursuant to People v. Wende (1979) 25 Cal.3d 436, we have reviewed the entire record and have concluded that there is no arguable issue on appeal.
The judgment is affirmed.
