Plaintiff Onofre Serrano appeals from the judgment of dismissal[1] following the sustaining without leave to amend the demurrer of Kevin Large, Carlos Solorzano, Barry Woods, M. Yarbourough, L. Bowen, J. Volletti, K. O'Dell, L. L. Suhulties, Nadeen Williams, V. Bolden, Ernie Roe, B. Bowen, Jerry Woods, Robert Legro, Suffner, Michael Stratman, James Lott, Gwendolyn Mitchell, K. Brainard, H. Brown, S. L. Reed, A. M. Gonzales, Spann, Larry Hood, C. Griffin, C. Carson, Allan Kittner, J. J. Cortez, D. E. Allen, R. M. Walton, R. Dottaviano, A. Espinosa, Morong, Chapel, J. Mathys, C. Campbell, Clauson, P. A. Anderson, Banton, Brooks, Kimberly Hayes, and Brenda Wimbush (collectively defendants).[2]


This action concerns incidents which allegedly arose during Serrano's incarceration at California State Prison – Los Angeles County (CSP-LAC) and primarily involves various tort claims against defendants, who are CSP-LAC employees. Serrano essentially claims that he was battered and unlawfully held in a security housing unit, which gave rise to mental, emotional, and physical injuries; that he was kept in a â€
