Giovanni Desorbo entered a negotiated guilty plea to possessing methamphetamine (Health & Saf. Code, § 11377) on March 8, 2005. The court suspended imposition of sentence and placed him on three years of formal probation, one condition of which was successful completion of a Proposition 36 drug treatment program. (Pen. Code, §§ 1210, 1210.1, subd. (a).) Probation was revoked and reinstated twice, each time following Desorbo's admission he had violated probation conditions. After the third revocation, the court found him unamenable to treatment (Pen. Code, § 1210.1, subd. (c)(2)), remanded him into custody, and ordered him evaluated for drug court. On October 27, 2005, Desorbo was accepted into drug court, released on his own recognizance, and ordered to complete an out-patient treatment program as a condition of probation. On November 3, 2005, the drug court terminated Desorbo for failing to appear and transferred the matter to the trial court for judgment and sentencing. At sentencing on November 28, 2005, the court found him in violation of probation, revoked and terminated probation, and sentenced Desorbo to the middle term of two years in state prison.
This appeal followed. We appointed counsel to represent Desorbo on appeal.
