After
finding James A. violated the terms of his juvenile court probation, the
court ordered him confined in a juvenile ranch program. style="mso-spacerun: yes"> The court set the maximum term of
confinement by calculating the maximum adult prison terms for the ward's
offenses. The court did not exercise
its discretion to set a maximum term based on the facts and circumstances of
his case. There was no error because
the court is required to set a discretionary maximum term only when a ward is
committed to the Youth Authority.
We affirm.
Factual
& Procedural Background
In February 2003,
James A. was declared a ward of the court
based on a finding that he committed second
degree burglary. He was placed on
probation in his mother's home. Between
December 2003 and August 2005, the court modified his probation five
times based on findings that he committed truancy, classroom disruption,
receipt of stolen property, battery on school grounds, href="http://www.sandiegohealthdirectory.com/">absconding from home, possession
of marijuana on school grounds, and marijuana use. In September 2005, the probation department alleged that
James A. continued to violate his probation by failing to attend an intake
appointment with a counseling program, failing to enroll in or attend school,
and refusing to live with his mother.
James A. admitted the violations.
At the jurisdictional and dispositional hearings, the court stated that
the maximum term of confinement for James A.'s offenses was three years
eight months. The court committed
James A. to the Orin Allen Youth Rehabilitation Facility for a â€
