THE COURT:
It is ordered that the opinion filed herein on April 18, 2006, be modified as follows:
1. On page 10, the third sentence of the first full paragraph is deleted.
2. On page 10, the sixth sentence of the first full paragraph is modified to read as follows:
Prihar was delegated the authority to act in this case by the terms
of the MOU.
There is no change in the judgment. Respondent's petition for rehearing is denied.
