BACKGROUND
On July 28, 2003, respondent filed a petition for letters to administer the estate of Rita Rozsypal, alleging that the decedent died intestate.[1] Appellant filed an objection to the petition, on the ground that the decedent had left a holographic will or a living trust.
On August 29, 2003, appellant Louise Rozsypal filed a petition in the trial court to determine the existence and validity of a trust, to determine that she was the beneficiary of the trust, and to appoint her as trustee.
