This appeal arises out of a medical malpractice claim by Deborah Friend (appellant) against her family physician, Dr. Michael Schierman (respondent). Appellant appeals from the Contra Costa County Superior Court's denial of her motion under Code of Civil Procedure section 473, subdivision (b) (hereafter section 473(b)) to vacate her voluntary dismissal of the case.[1]
