Defendant and Appellant Aegis Security Insurance Company (Aegis) challenges the superior court's ruling denying its motion to vacate the forfeiture of its bond in the underlying criminal matter of People v. Angel Gomez (San Bernardino Superior Court case No. FVA 019779 (FVA 019779)). For the reasons set forth below, we remand the matter to the trial court with instructions to exercise its discretion to determine whether Aegis received prior notice of the June 24, 2003, reinstatement as required by Penal Code section 1305, subdivision (c)(4).
Facts and Procedural Background
Angel Gomez (Gomez) was arrested in San Bernardino County on May 14, 2003. Aegis posted the subject bond in the amount of $500,000 on May 21, 2003, and Gomez was released. The bond indicated that Gomez was ordered to appear on June 23, 2003, and that Aegis undertook that Gomez would appear â€
