Jake Jones appeals from an order increasing his child support obligation to $850 a month. He contends the trial court abused its discretion in imputing income of $4,000 a month to him. He further contends there were no changed circumstances to justify a modification of the child support order. The record on appeal consists only of a clerk's transcript. Based on the evidence in the record and the presumption in favor of the validity of an order, we find no error and affirm.
FACTUAL AND PROCEDURAL BACKGROUND
Jones and Jacquelyn Willis are the parents of a daughter born in 1997. In 2000, the court found Jones had a total earning ability of $2,000 a month and ordered him to pay $438 a month in child support.
In 2004, Willis brought a motion to modify child support. She claimed Jones had lied on his income and expense declaration. She estimated he had a monthly income of $7,000. Her estimate was based on his being a business partner and owning 5,000 acres, 3,200 head of cattle, and a boat; Jones also sold horses for $5,000 each.
Jones submitted an income and expense declaration showing a monthly income from McClelland Ranch of $400 a month.
At trial, the parties and various other witnesses testified. No transcript of this testimony is part of the record on appeal. The parties agreed Jones had no parenting time and Willis was unemployed. A balance sheet for McClelland Ranch showed accumulated depreciation of $217,579 and undistributed income of $83,404.12. Jones had started the Lanes Valley Hunting Club on the ranch.
