IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SIXTH APPELLATE DISTRICT

In re N. S., a Person Coming Under the Juvenile Court Law.

H028922

(Santa Clara County

Super. Ct. No. JD15418)

SANTA CLARA COUNTY DEPARTMENT OF FAMILY AND CHILDREN'S SERVICES,

Plaintiff and Respondent,

v.

J. H.,

Defendant and Appellant.

In this dependency matter, the child's maternal aunt, J.H., appeals from an order sustaining a supplemental petition under Welfare and Institutions Code section 387[1] and finding that the previous placement with her was not effective in protecting the child. She contends that the order was not supported by substantial evidence and she raises various asserted procedural irregularities. We find that the proceedings on the section 387 petition were entirely proper and that substantial evidence supported the court's findings. We therefore affirm the order.

BACKGROUND

We take the background in this case from our recent opinion in H029166, filed December 29, 2005, in which we affirmed orders terminating the parental rights of the mother to this child, N.S., and his twin sister S.S.
