Lionel Brackins appeals from a judgment entered on his plea of nolo contendere. His counsel raises no issues and asks this court for an independent review of the record to determine whether there are any arguable issues. (People v. Wende (1979) 25 Cal.3d 436.)


On February 8, 2005, the People filed an information charging defendant with possession of a firearm by an ex-felon and willful discharge of a firearm in a grossly negligent manner (Pen. Code, §§ 12021, subd. (a)(1), 246.3). On June 20, 2005, defendant waived his right to a jury trial and entered a plea of nolo contendere to the section 246.3 offense. The plea was entered with the understanding that defendant would be referred to the probation department with a â€
