It is ordered that the opinion filed on September 28, 2006, be modified as follows:
On page 3, in the first paragraph of the “Discussion“ section, the second sentence beginning with “However, and somewhat curiously” is deleted. The second paragraph beginning with “The governing statute” will now continue as part of the first paragraph.
This modification does not effect a change in the judgment. The petition for rehearing is denied.
