On January 11, 2017, Ryan Curtis determined someone had broken into his employer’s business and stole about $15,000 in items from his work truck parked there the day before. On January 13, 2017, a large box truck entered the unsecured gate of the business and the occupant stole 10 large box truck tires with an estimated value of $2,500. Curtis reported to police on January 15 that he saw a vehicle that looked like the one associated with the theft. The following day, deputies responded to the address and contacted defendant Jason Brett Fowles, who was standing in the driveway. Defendant was on searchable probation; he admitted owning the truck and consented to it being searched. Methamphetamine and a glass smoking pipe were found on defendant, and deputies also found items associated with the thefts.
Defendant admitted to the first theft but denied the second. He described a four-year crime spree in the Sacramento area and Butte County in which he committed thefts at night after getting high on methamphetamine. During the subsequent investigation, he admitted to numerous thefts in Butte County and the Sacramento region. Defendant also admitted having firearms in his garage. A search of his garage found several firearms taken in a burglary as well as six large boxes of assorted coins and china from another burglary. Defendant described the stolen property as his “prized possessions,” which he obsessed over. He had two large storage units in the Sacramento area where he stored his stolen property. Several times he had to sell the property to make room for new property. He made a down payment of $135,000 on the property where he was found with the proceeds from stolen property.
Defendant pled guilty to second degree burglary, grand theft, and felon in possession of a firearm. The trial court sentenced him to four years four months in state prison, imposed various fines and fees, and awarded nine days of presentence credit (five actual and four conduct).
Defendant appeals. His request for a certificate of probable cause was denied.
We appointed counsel to represent defendant on appeal. Counsel filed an opening brief that sets forth the facts of the case and requests this court to review the record and determine whether there are any arguable issues on appeal. (People v. Wende (1979) 25 Cal.3d 436.) Defendant was advised by counsel of the right to file a supplemental brief within 30 days of the date of filing of the opening brief. More than 30 days elapsed, and we received no communication from defendant. Having undertaken an examination of the entire record, we find no arguable error that would result in a disposition more favorable to defendant.
DISPOSITION
The judgment is affirmed.
