After finding defendant Lucian Dragos Burcea violated his probation, the court sentenced him to the upper term of four years for spousal battery in case No. 03F10812, and eight months (one-third the midterm) for possessing a controlled substance in case No. 04F11030, to be served consecutively.
At sentencing, the court declined to grant probation because (among other reasons) defendant's prior record is lengthy and increasingly involves crimes of violence, and then imposed the upper term sentence after finding eight factors in aggravation, including that â€
