IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA
SECOND APPELLATE DISTRICT
DIVISION SIX
THE PEOPLE, Plaintiff and Respondent, v. JOSE LUIS RUIZ, Defendant and Appellant. | 2d Crim. No. B184769 (Super. Ct. No. 2005011862) (Ventura County)
|
Jose Luis Ruiz appeals the judgment entered after he pled guilty to possession of a controlled substance (Health & Saf. Code, § 11377, subd. (a)) and misdemeanor driving under the influence (DUI; Veh. Code, § 23152, subd. (a)). Appellant also admitted that he had suffered a prior strike conviction. (Pen. Code, §§ 667, subd. (e)(1); 1170.12, subds. (b) & (c)(1).) He was sentenced to 32 months state prison and a concurrent six month jail sentence on the misdemeanor DUI count. The trial court ordered appellant to pay a $165 crime lab fee (Health & Saf. Code, § 11372.5), a $495 drug program fee (Health & Saf. Code, § 11372.7, subd. (a)), a $500 restitution fine (Pen. Code, § 1202.4, subd. (b)), and a $500 parole revocation fine (Pen. Code, § 1202.45).
We appointed counsel to represent appellant in this appeal. After counsel's examination of the record, he filed an opening brief raising no issues.
On December 19, 2005, we advised appellant that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have not received a response from him.
We have reviewed the entire record and are satisfied that appellant's attorney has fully complied with his responsibilities and that no arguable issue exists. (People v. Wende (1979) 25 Cal.3d 436, 441.)
The judgment is affirmed.
