Defendant Edward Thomas appeals from a judgment entered following a court trial. The court found defendant not guilty of one count of assault with a deadly weapon against Correctional Officer Ruben Villanueva (Pen. Code, § 4501),[1] and guilty of one count of battery upon the same correctional officer (§ 4501.1). The court also found defendant guilty of two counts of resisting or deterring an officer (§ 69), found true the allegation that defendant had suffered one prior â€
