P. v. Fitzpatrick
Paul Leo Fitzpatrick appeals a felony conviction after a bench trial of one count of making criminal threats (Pen. Code, 422) (hereafter section 422). On appeal, appellant contends the evidence was insufficient to support his conviction and the trial court erred in imposing the upper term sentence. Court disagree and affirm.
