In re Brian C.
In March 2006, a petition filed in juvenile court alleged Brian C. committed grand theft (Pen. Code, 487, subd. (a)). Brian admitted the truth of the allegation, and the court placed him on juvenile probation. The terms of his probation included a Fourth Amendment waiver. A few months later, Brian was arrested after police officers discovered a previously lost cell phone in Brians possession. A petition was filed alleging he committed petty theft of lost property (Pen. Code, 485). Brians motion to suppress the cell phone and his statements to the officers was denied, he admitted the truth of the allegation and was placed on probation.
