Myrick v. City of Paso Robles
This case arises out of the tragic death of Jennifer Lynn Myrick. Myrick was killed when a portion of a privately owned, unreinforced masonry building collapsed on her as she stood on a public street during an earthquake. Myrick's parents Leroy and Vicky Myrick (the Myricks) sued the City of Paso Robles (the City) alleging a dangerous condition of public property and nuisance. The trial court granted the City's motion for summary judgment on the ground, among others, that the City is immune from liability under Government Code section 8875.3. Court affirm.
