P. v. Tran
A jury found defendant Cuong Vinh Tran guilty of two counts of robbery and one count of attempted robbery. He appeals, arguing that the trial court should have instructed the jury on attempted theft as a lesser included offense of attempted robbery, and that the court erred in admitting certain hearsay statements. We conclude the trial court properly refused to instruct on attempted theft and that the hearsay statements were properly admitted as prior consistent statements. Therefore Court shall affirm.
