Elliott v. Regents of the University of California
In this case we consider whether Margaret Elliotts lawsuit against her employer for discrimination, retaliation and related tort claims is barred by the doctrine of res judicata due to her failure to exhaust her judicial remedies. We hold that Elliotts failure to judicially challenge an adverse ruling in an administrative grievance proceeding precludes her from suing her employer to recover for her alleged employment-related harm. Accordingly, Court affirm summary judgment in favor of the Regents of the University of California (the Regents) and individual defendant Dan Judd.
